1. Acceptance of Terms
By downloading, installing, or using Aina Adventures ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Mana Voyage LLC ("Company," "we," "us," or "our").
2. Description of Service
Aina Adventures is a self-guided tour application covering all six major Hawaiian islands — O'ahu, Maui, the Big Island (Hawai'i Island), Kaua'i, Moloka'i, and Lāna'i — featuring AI-powered guide characters, interactive maps, itinerary planning, a digital passport and achievements system, and community photo/video sharing. The App is provided by Mana Voyage LLC.
3. Subscriptions, Billing, and Refunds
3a. Free and Premium Tiers
Aina Adventures offers a free trial that allows you to experience the app's features before committing to a subscription. Once the trial period ends, premium features will be locked and you will be prompted to subscribe. Premium features, including access to all AI guides and unlimited messaging, require a paid subscription — available as a monthly plan or at a discounted annual rate.
3b. Subscription Plans
- Monthly Subscription: Billed on a recurring monthly basis at the price displayed at the time of purchase.
- Annual Subscription: Billed on a recurring annual basis at the price displayed at the time of purchase, offering a discount compared to the monthly rate.
All prices are subject to change. Price changes will not affect active subscription periods but will apply upon renewal.
3c. Payment Processing
All payments are processed through the Apple App Store or Google Play Store, depending on your device. Mana Voyage LLC does not directly collect or store your payment information. All billing inquiries, payment disputes, and transaction records are managed through your respective app store account.
3d. Free Trials
If a free trial is offered, your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial expires. You may cancel a free trial at any time through your app store account settings.
3e. Automatic Renewal and Cancellation
- Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
- You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
- Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid period.
- Deleting the App does not cancel your subscription. You must cancel through your app store account.
3f. Refunds
Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. Mana Voyage LLC does not process refunds directly. To request a refund:

4. AI Guide Disclaimer
The AI tour guides in Aina Adventures are powered by artificial intelligence (xAI/Grok) and are intended for informational and entertainment purposes only. Information provided by AI guides may not always be accurate, current, or complete. Always verify important information (trail conditions, business hours, safety warnings) through official sources before making decisions. Mana Voyage LLC is not responsible for any actions taken based on AI-generated information.
5. User-Generated Content and Content Rights
Aina Adventures allows users to upload photos, videos, and other content ("User-Generated Content" or "UGC") to community galleries and other features within the App. By submitting or uploading any UGC, you agree to the following:
- Ownership: You retain full ownership of any content you create and upload to the App.
- License Grant: By uploading UGC, you grant Mana Voyage LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute your content in any media or format, including but not limited to marketing materials, social media channels, websites, promotional campaigns, advertisements, print media, and any other commercial or non-commercial purposes.
- Representations: You represent and warrant that you own or have the necessary rights, licenses, and permissions to grant the above license, and that your UGC does not violate any applicable laws, regulations, or third-party rights, including intellectual property rights, privacy rights, or publicity rights.
- Prohibited Content: You agree not to upload content that is illegal, defamatory, obscene, harassing, threatening, invasive of privacy, infringing on intellectual property, or otherwise objectionable. Content depicting minors without parental consent is strictly prohibited.
- Content Moderation: Mana Voyage LLC reserves the right, but has no obligation, to review, monitor, edit, or remove any UGC at its sole discretion, for any reason, including but not limited to content that violates these Terms or is deemed inappropriate, without notice to you.
- No Compensation: You acknowledge that no compensation will be paid to you for the use of your UGC by Mana Voyage LLC under the license granted herein.
- Indemnification: You agree to indemnify and hold harmless Mana Voyage LLC from any claims, damages, or expenses arising from your UGC or your breach of these content rights provisions.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Upload offensive, harmful, or misleading content
- Attempt to interfere with the App's functionality or security
- Use the App in a way that could endanger yourself or others
- Attempt to bypass subscription restrictions, usage limits, or other access controls
- Use automated systems, bots, or scripts to interact with the App or its AI features
- Reverse engineer, decompile, or disassemble any part of the App
7. Safety and Responsibility
Aina Adventures provides information about outdoor locations, trails, beaches, and natural areas. You are solely responsible for your own safety when visiting any location. Always:
- Check current conditions and weather before visiting outdoor locations
- Follow all posted signs, warnings, and local regulations
- Respect Hawaiian culture, sacred sites, and natural environments
- Exercise caution near ocean areas, cliffs, and hiking trails
- Travel with appropriate supplies, footwear, and sun protection
8. Intellectual Property
All content, features, and functionality of Aina Adventures — including but not limited to the AI guide characters (Pono, Asahi, Leilani, Koa), artwork, logos, text, graphics, software, and design — are owned by Mana Voyage LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without prior written consent from Mana Voyage LLC.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MANA VOYAGE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF MANA VOYAGE LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL MANA VOYAGE LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP EXCEED THE AMOUNT YOU PAID TO MANA VOYAGE LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Mana Voyage LLC is not liable for any injuries, damages, or losses arising from visiting locations featured in the App. The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify, defend, and hold harmless Mana Voyage LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
Mana Voyage LLC reserves the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Hawai'i, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Honolulu, Hawai'i. The arbitrator's decision shall be final and binding.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive your right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in the state or federal courts of Honolulu, Hawai'i, to protect intellectual property rights or prevent irreparable harm.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
14. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mana Voyage LLC regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.
15. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last Updated" date above. Continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the App.
